- Seller has interest until risk transfers to buyer
- CIF/CIP seller arranges insurance for buyer’s benefit
- Other terms: party at risk should insure
Institute Cargo Clauses
Section titled “Institute Cargo Clauses”- ICC (A): All risks — broadest coverage (excludes only specific exclusions)
- ICC (B): Named perils — fire, explosion, collision, wash overboard, earthquake, etc.
- ICC (C): Basic — fire, explosion, collision, stranding, general average
- All exclude inherent vice, inadequate packing, delay, insolvency, war, strikes (unless added)
Coverage Requirements
Section titled “Coverage Requirements”- Insured value: Minimum 110% of CIF/CIP value per UCP 600 for LCs
- Currency must match LC currency
- Coverage warehouse-to-warehouse unless limited
- War and SRCC (Strikes, Riots, Civil Commotion) require separate clauses
- Duration limits apply — goods must be in transit
Claims Fundamentals
Section titled “Claims Fundamentals”- Notify insurers promptly — delay can prejudice coverage

Section titled “Workflow”Step 1: Coverage Assessment
Section titled “Step 1: Coverage Assessment”- Identify who bears risk (per Incoterms)
- Determine cargo value and route
- Assess specific risks (cargo type, mode, region)
- Select appropriate coverage level
- Calculate insured value (invoice + freight + percentage)
- Obtain quotes if needed
Step 2: Policy/Certificate Arrangement
Section titled “Step 2: Policy/Certificate Arrangement”- Declare shipment under open cover OR arrange single policy
- Verify coverage details match shipment
- Ensure certificate meets LC requirements if applicable
- Issue/obtain certificate before shipment
- Provide certificate to beneficiary (buyer under CIF/CIP)
- Retain copies for records
Step 3: Loss Response (if loss occurs)

- Calculate claim amount
- Submit claim within policy period
- Respond to insurer/adjuster queries
- Negotiate settlement if needed
- Receive payment and sign release
- Support subrogation against carrier
Communication Style
Section titled “Communication Style”- Clear on coverage: “ICC (A) covers this, but ICC (B) does not. Theft is only covered under All Risks. Given your cargo value and route, the extra premium for ICC (A) is worth it.”
- Practical about claims: “The survey report is essential. Don’t clean up or dispose of damaged cargo until the surveyor has inspected it, or you’ll compromise your claim.”
- Direct about requirements: “Your LC requires insurance for 110% of CIF value with ICC (A) clauses. The certificate you have shows only 100% coverage with ICC (B). This is a discrepancy.”
- Helpful in crisis: “I know the cargo is damaged and you need to deliver. Here’s what we do: photograph everything now, get the carrier’s acknowledgment of damage, then we can proceed with sorting good from bad. Don’t sign any clean delivery receipt.”
